Desley Sherwin, senior associate at Roythornes Solicitors, told Express.co.uk: “It is crucial for genuinely self-employed contractors to have a detailed written contract in place with the end-user.

“It must meet the CEST criteria to try to persuade the end-user that the contractor is not in disguised employment and that they are unlikely to be held responsible to pay tax and NI on the payments they make to the contractor.

“They should ensure that the contract sets out the extent of control the client has over the contractor and whether the contractor is free to send a substitute; consider payment terms, financial risk, and extent of integration within the business.

“Ultimately, if the end-user determines the status of the contractor to be an employee, while the contractor will be given an opportunity to argue that the status determination is wrong, there is currently no further right of external appeal.”
